TERMS OF SERVICE

Last updated/reviewed: 11 September 2024The following information applies to all clients. Friends and/or regular commissioners are NOT exempt from these terms. Please read carefully before commissioning.
These terms are subject to change at any point without notice.Acceptance• The artist (hereafter “I” / “me”) will only accept commissions from people aged 18 and older.
• Should the client (hereafter “you”) choose to commission me for an adult/NSFW art piece, you agree to being 18 years or older, and I reserve the right to ask for ID as proof.
      ○ Lying about age/ID will result in blacklisting.
• If the commission is to remain private or as a gift/surprise, inform me when you contact me.
      ○ If it is a gift/surprise, you may also give a date on when I can freely post the commission.
• I reserve the right to refuse service for any reason.Payment/Processes• Once accepted, I will invoice you via PayPal for payment of your commission within 24 hours
• Currency is strictly Australian Dollars (AUD).
• Payments not made within 2 business days of the invoice being sent will be put on hold and you shall lose your current position in the queue.
• If payment is not made within a week of the invoice being sent, the commission will be rejected.
• I will not start a commission until the invoice has been paid in full, unless part of a payment plan.
      ○ Payment plans can be arranged for commissions over $200.
      ○ The final product will not be finished/given until full payment is complete.
• You are expected to keep invoice emails for your own records or for refunding purposes.
• If the commission is SFW, there is a possibility the process will be streamed unless otherwise agreed upon.
• You will get 3-5 opportunities (depending on size) to request edits and alterations during the commission process. Extra alterations/changes after these will incur extra charges.
      ○ Note that any mistake in the commission that was my fault (ie. Not made due to miscommunication or poor references) can be fixed free of charge.
• Once a commission is started, you will receive a sketch to approve or change using your allocated edits.
• Once each stage is completed, I will notify you to be sure no details have been lost in communication.
• I reserve the right to refuse other changes at the end of the commission unless it is a mistake made by myself (ie. Marking/colour mistakes).Additional Charges• High-detail characters (ie. Complex markings or anatomy) will incur additional charges depending on the level of detail.
• Failing to provide a reference sheet, or giving only a text description of the character, will incur additional charges (excluding reference sheet commissions).Refunds• Should you decide to cancel a commission, please message me as soon as possible.
      ○ Full refunds before commission is started or still in the sketch stage. If refunded in this stage, I reserve the right to repurpose/resell the sketch as a YCH or other commission type (with any elements of your character removed).
      ○ Partial refunds if the commission is in the lining stage, depending on the size/scope of the piece.
      ○ No refunds after entering the colouring stage.
• A refund will otherwise only be issued if I am unable to finish the commission for certain reasons, such as severe sickness or some form of emergency.Time Estimates• Once you have been informed your commission has begun, please allow for around 4-8 weeks for completion.
• If an incident occurs that delays commissions for whatever reason, I will announce it on my social media. I will try to inform you directly, but this is not guaranteed.
• If you wish for the commission to be completed quicker or by a certain deadline, you will pay an extra 25-50% of the cost of the commission as a “rush/priority fee” (depending on the commission type).Rights• When you receive a commission from me, you receive it under a personal use license, meaning you may NOT make any profit from the work unless a reproduction payment is made.
• I retain the rights to all commissions I complete and will post the finished products on my pages/social media. You have purchased it for personal use only and may not redistribute the image for profit or alter it without written permission from me (cropping for avatars/banners excepted).
• You may repost any commission you purchase from me onto your own accounts so long as credit is given, and the image is unchanged.
• You will receive a high-resolution version of the image and a low-resolution version for uploading purposes.
• I reserve the right to sell prints of any artworks created. This is purely the art print being sold, not your character rights/ownership.
      ○ Any images may also be used by me for my own art portfolio or as future examples for commissions.
• If you have objections to your commission being printed, used in a portfolio, or used as an example for that type of commission, please state so when you first contact me and I will oblige.
• I do not permit the training of AI learning models using my art as a base, or being used for any kind of Non-Fungible Tokens (NFTs).
